§ 12-6 PERMITS; FEES; PERMANENT MARKERS.
   (A)   Duty to notify cemetery officials. The cemetery lot owner, the owner’s heirs or owner’s representative shall notify the Council, or cemetery manager, of the owner, owner’s heirs or representative’s approval to bury a person at the cemetery lot.
   (B)   Burial permit fee. A burial permit must be obtained from the cemetery manager prior to the burial or internment on any cemetery lot. The application for a burial permit shall be accompanied by the payment of a burial permit fee in an amount as established from time to time by the town council and set forth in the schedule of fees and charges, available for public examination in the town clerk’s office. No burial permit may be issued unless all charges against the cemetery lot have been paid, unless otherwise approved by the Council and then only if the owner, owner’s heirs, or owner’s representative agrees in writing for the payment of any outstanding charges. When a burial permit is issued, the person shall be provided a copy of this chapter and any rule, regulation, policy or procedure, by whatever term designated, then in force and the person shall acknowledge in writing receipt of the materials. All burials withing the Kershaw Cemetery will only be conducted by the official contracted town burial provider.
   (C)   Permanent markers.
      (1)   Fee. In addition to payment of a burial permit fee, a permanent marker fee in an amount as established from time to time by the Town Council and set forth in the schedule of fees and charges, available for public examination in the Town Clerk’s office must be paid not later than the time the application for a burial permit is filed. The permanent marker fee shall be refunded to the payee if a permanent marker is placed on the cemetery lot not later than 12-months after the burial or internment.
      (2)   Required; time restriction. A permanent marker must be placed over each grave by the cemetery lot owner, the owner’s heirs or owner’s representative within 12-months after the burial or internment. If the permanent marker is not installed within 12-months after the burial or interment, then the Council shall provide for the installation of a permanent marker using the permanent marker fee paid at the time the burial permit was obtained. Permanent markers must be set at ground level.
      (3)   Maintenance care fee. Prior to the erection or installation of a permanent marker or monument, the cemetery lot owner, the owner’s heirs or the owner’s representative, is required to pay a maintenance care fee in an amount as established from time to time by the Town Council and set forth in the schedule of fees and charges, available for public examination in the Town Clerk’s office.
   (D)   Coping placement fee. Prior to the placement or installation of coping around a grave, the cemetery lot owner, the owner’s heirs or the owner’s representative, is required to pay a coping placement fee in an amount as established from time to time by the Town Council and set forth in the schedule of fees and charges, available for public examination in the Town Clerk’ office. All coping in the new cemetery section must be installed at ground level.
   (E)   Disposition of fees. Fees collected pursuant to this section must be credited to the town’s General Fund Cemetery Account.
   (F)   Manager’s responsibilities. The cemetery manager shall issue the burial permit if the requirements of this article have been met and all charges against the cemetery lot are paid. The cemetery manager is responsible for entering the burial information into the cemetery records and providing information to funeral homes on required permits and fees.
   (G)   Schedule of fees.
      (1)   All fees must be paid before burial.
      (2)   Fees and charges are available for public examination in the Clerk’s office.
