(A) In this section, the phrase “violation of any such provision of this code or any ordinance” means any of the following:
(1) Doing an act that is prohibited or made or declared unlawful, an offense, a violation or a misdemeanor by ordinance or by rule or regulation authorized by ordinance;
(2) Failing to perform an act that is required to be performed by ordinance or by rule or regulation authorized by ordinance; and/or
(3) Failing to perform an act if the failure is prohibited or is made or declared unlawful, an offense, a violation or a misdemeanor by ordinance or by rule or regulation authorized by ordinance.
(B) Whenever in this code or in any ordinance, resolution, rule, regulation or order promulgated by any agency or officer thereof under authority duly vested in him, her or it, any act is prohibited or is made or declared to be unlawful or an offense or misdemeanor, or the doing of any act is required, where no specific penalty is provided for the violation thereof, the violation of any such provisions of this code, ordinance, resolution, rule, regulation or order shall be punished by a fine not exceeding $500 or by imprisonment for a period not exceeding 30 days, or both; provided, however, that, no penalty shall exceed the penalty provided by state law for similar offenses. Each day any violation of this code or any ordinance, rule or regulation shall continue shall constitute a separate offense.
(C) A violation of this code does not include the failure of a law enforcement officer or town employee to perform an official duty unless it is specifically provided that the failure to perform the duty is to be punished as provided in this section.
(D) The imposition of a penalty under the provisions of this code shall not prevent the revocation or suspension of any license, franchise or permit issued or granted under the provisions of this code.
(E) Violations of this code that are continuous with respect to time are a public nuisance and may be abated by injunctive or other equitable relief. The imposition of a penalty does not prevent injunctive relief.
