§ 93.99 PENALTY.
   (A)   Any person who violates any provision of this chapter other than §§ 93.05 or 93.06 shall, upon conviction thereof by a court of competent jurisdiction, be guilty of a Class B Misdemeanor and shall be subject to a fine of up to $250 or imprisonment of up to 90 days in jail, or both. Each day that such violation occurs, exists or continues shall be deemed to be a separate offense.
   (B)   Any person who is responsible for the release or substantial threat of a release of hazardous materials into the environment in violation of § 93.05 or who fails to report such release or threatened release in violation of § 93.06 of this chapter shall, upon conviction thereof by a court of competent jurisdiction, be guilty of a Class A Misdemeanor and subject to a fine of up to $500 or imprisonment of up to one year in jail, or both. Each day that such violation occurs, exists or continues shall be deemed to be a separate offense.
   (C)   In addition to the penalties provided in divisions (A) and (B) above, any person violating any provisions of this chapter shall become liable civilly to the appropriate county or city government for any expense loss or damage to the government or agency thereof caused by reason of such violation, including, but not limited to, any clean-up, evacuation, administration or other expenses, and legal expenses.
