§ 32.04 ELECTIONEERING ON ELECTION DAY.
   (A)   To fulfill the government's obligation to protect the integrity of the election process and voters from actual or attempted fraud, obstruction, intimidation - real or inferred, attempted or actual vote buying, and from voter harassment - real, threatened or implied, all done under the guise of electioneering, a 100-foot electioneering free zone is hereby established. No electioneering shall occur within 100 feet of the main entrance to any building located in Kenton County and containing a polling place during the hours that it is open and accessible to the public for the purpose of voting on election day as established in KRS 118.025. Electioneering shall include the display of signs, the distribution of campaign literature, cards, or handbills, the soliciting of signatures to any petition, or the soliciting of votes for or against any political party, candidate or questions on the ballot in any manner. Nothing contained in this section shall prohibit electioneering conducted on private property that is within the electioneering free zone, or electioneering in the manner that is expressly excepted from regulation by the Kentucky State Board of Elections. And nothing in this section shall prohibit the displaying of political signs on private property by or with the consent of a person having a leasehold or ownership interest in that property, regardless of the distance from the polling place.
   (B)   Any precinct election officer, County Clerk, Deputy County Clerk, or any law enforcement official may enforce this section. Assistance may be requested of any law enforcement officer.
   (C)   Violators of any provision of this section shall be guilty of a Class A Misdemeanor under the laws of the Commonwealth of Kentucky and fined up to $500 and/or face up to one year in the county jail per violation.
