§ 95.52 POLICY.
   (A)   Repair of damaged mailbox. If the Superintendent of Kenton County Public Works determines that a mailbox damaged during snow removal by a county employee may be repaired to its original condition, he or she may, at his or her discretion, repair the mailbox in lieu of replacement.
   (B)   Replacement of destroyed mailbox. If the Superintendent of Kenton County Public Works determines that a mailbox has been destroyed beyond repair by a county employee, he or she may, at his or her discretion, order the mailbox replaced.
      (1)   Replacement mailbox design. The Superintendent of Kenton County Public Works shall replace a destroyed mailbox with one black metal mailbox approved for ordinary use by the United States Postmaster General, affixed to a wooden support no larger than four inches in length by four inches in width, or standard steel or aluminum pipe, no larger than two inches in diameter. The post shall be installed to conform with the mailbox guidelines set forth by the United States Postal Service.
      (2)   Limitations on replacement. Any property owner whose mailbox has been destroyed by Kenton County Public Works shall be entitled to one mailbox and one post per six month period.
   (C)   Rejection of repair or replacement. In the event a property owner refuses to allow Kenton County Public Works to repair or replace the damaged mailbox, the property owner shall be deemed to have waived any right to repair or replacement of that mailbox under the terms of this subchapter.
   (D)   Superintendent discretion. Any decision on repair or replacement of a mailbox pursuant to this subchapter shall be at the sole discretion of the Superintendent of Kenton County Public Works.
