(A) Any violation of this chapter shall be deemed a Class A Misdemeanor, and shall be subject to such penalties as are provided under Kentucky Revises Statutes.
(B) In addition any person who knowingly or by willful disregard causes the removal or destruction of a control marker or monument under this chapter shall cause the marker or monument, at his or her own expense, to be re-established under the supervision and approval of the NKAPC. In addition to any fine set forth below, the offending person shall also pay, to the Fiscal Court, as a penalty, $4,000 for each monument effected.
