828.01 DEFINITIONS.
   As used in this chapter:
   (a)   "Canvasser" and "solicitor" mean any individual, whether a resident of the Municipality or not, travelling either by foot, wagon, automobile, motor truck or any other type of conveyance, from place to place, from house to house, or from street to street, taking or attempting to take orders in person or by telephone for the sale of goods, wares and merchandise or personal property of any nature whatsoever, for future delivery, or for services to be furnished or performed in the future. In addition to the exceptions listed in subsection (b) hereof, this definition does not apply to persons selling by sample only, nor to any agricultural articles or products offered for sale by the producer thereof, nor to individuals working for or on behalf of any recognized educational, civic, religious, medical or charitable organization or cause.
   (b)   "Peddler" means any person who carries with him for the purpose of sale and immediate delivery, from house to house, goods, wares and merchandise.
   Exceptions to the definitions of "peddler," "canvasser" and "solicitor" are the following:
      (1)   A person selling or making delivery of goods, wares or merchandise theretofore sold by an establishment having a permanent place of business within the City;
      (2)   A minor under eighteen years of age;
      (3)   A person making sales of the following items of daily household consumption:
         A.   Baked goods;
         B.   Fruit and vegetables;
         C.   Dairy products, except dealers of frozen desserts from vehicles.
   (c)   "Cold canvass" means the uninvited telephone contact of a person by a canvasser or solicitor not having a permanent place of business within the City.
