249.28 DEMOTIONS.
   A demotion is the act of reducing an employee to a classification, which requires less skill, knowledge and ability and requires performance of less complex and less responsible work than the employee was required to perform in his or her previous position. A demotion also involves reducing the employee to a lower pay range. As a result, care should be exercised to ensure that such action is justified and that it is implemented consistent with provisions outlined in the Ohio Revised Code. A demotion may occur because an employee has exhibited an inability or unwillingness to handle his or her duties and responsibilities; for disciplinary reasons; or as a result of a reduction in force. Regardless of the reason, the employee shall always be assigned to that pay range assigned to the employee’s new classification. The exact rate shall be determined by the appointing authority and approved by Council but such rate shall never exceed the amount the employee was earning in the classification from where he or she was demoted.
