249.03 EMPLOYEE STATUS.
   (a)   All employees of the City shall be classified as full-time, part-time, temporary, seasonal, intermittent or interim, as follows:
      (1)   Full-time employee: An employee who is scheduled at least thirty-five (35) hours per calendar week on a regular scheduled basis.
      (2)   Part-time employee: An employee who is scheduled less than thirty-five (35) hours per calendar week, but on a regularly scheduled basis.
      (3)   Temporary employee: An employee hired for a limited period of time, fixed by the appointing authority, for a period not to exceed ninety (90) work days. A temporary employee normally is exempted from participating in the Public Employees Retirement System (PERS).
      (4)   Seasonal employee: An employee who works a certain regular season or period of the year performing some work or activity limited to that season or period of the year. A seasonal employee is not exempted from participating in PERS.
      (5)   Intermittent employee: An employee who works an irregular schedule, which is determined by the fluctuating demands of the work, which are not predicable. Intermittent employees work no longer than 1040 hours per calendar year and are not exempted from participating in PERS.
      (6)   Interim employees: An employee hired to fill a vacancy created by the sickness or disability of a regular employee for the period of the sickness or disability. Interim employees are not exempted from participating in PERS.
   (b)   Full-time employees shall be entitled to all benefits provided to the City. Part-time police dispatchers are entitled to vacation and sick leave only. All other part-time employees are entitled to sick leave only. Temporary, seasonal, intermittent and interim employees are not eligible for sick leave, holiday pay, vacation or insurance benefits.
   (c)   If a part-time, permanent, temporary, seasonal, intermittent or interim employee works thirty-five (35) hours or more per week, for more than thirty (30) days, he or she may apply for a change of status. The decision to grant the change of status shall be left to the discretion of the appointing authority.
   (d)   Employees may change their status only with the approval of the appointing authority and when it is in the best interest of the department.
   (e)   Interim appointees are to be notified, in writing, as a condition of employment, that their appointment shall cease upon the return of the regular employee for whom the interim employee is working. Likewise, temporary and seasonal employees shall be so notified that their employment is of a temporary or seasonal nature. Such notification shall also include the date of hire and anticipated date of cessation of employment.
   (f)   The following classifications shall be designated as department heads/management: Fire Chief, Police Chief, Chief Deputy Auditor, Public Works Superintendent, Municipal Court Clerk, Safety and Service Director, Income Tax Administrator, Wastewater Treatment Plant Superintendent Operator of Record, Water Treatment Plant Superintendent Operator of Record, and Parks and Recreation Director. The Safety and Service Director and Income Tax Administrator shall be appointed by the Mayor. The Fire Chief, Police Chief, Public Works Superintendent, Wastewater Treatment Plant Superintendent Operator of Record, Water Treatment Plant Superintendent Operator of Record, Parks and Recreation Director and other service employees shall be appointed by the Safety and Service Director. The Auditor shall appoint the Chief Deputy Auditor and other audit employees. The Municipal Court Judge shall appoint the Municipal Court Clerk. The Municipal Court Clerk shall appoint Deputy Court Clerks. Council shall appoint the Clerk of Council.
   (g)   The following employees are designated as confidential, supervisory, fiduciary, management and/or otherwise exempted personnel below the department head level. Class title: Chief Deputy Court Clerk, Customer Service Supervisor, Deputy Court Clerk, Police Lieutenant, Police Sergeant, Assistant Fire Chief, Fire Captain, and Clerk of Council.
