1438.05 EQUITABLE REMEDIES.
   Whenever any building or addition to any building has been erected, placed, repaired or removed, or is about to be erected, placed, repaired or removed, upon any lot or land lying in any of the squares or half-squares within the fire limits, contrary to any of the provisions of this chapter, the Fire Chief shall report the same to the Mayor, together with a description and the situation of such building, repair or addition to any building, or the proposed situation of the same, and the Mayor shall thereupon notify in writing the person so offending to remove the same from such fire limits, or to desist from erecting, placing, repairing or removing the same. If such notice is not complied with within ten days from the time of service of the same upon such person, the Mayor shall give information of such fact to the Solicitor who shall thereupon prosecute such offender for such violation and the Safety-Service Director shall thereupon, without delay and with as little injury to the building, addition or material for the same as is practicable, remove such building or addition or the combustible materials provided for the same from such fire limits to any suitable place that the Fire Chief directs. For the purpose of accomplishing such removal, the Director may employ such labor and means as are necessary and he shall be protected by the Police Department. In addition, he shall give to Council forthwith, and in detail, a statement of the expense incurred in effecting such removal. Thereupon the Solicitor shall institute an action for the recovery of such expense in the name of the City against the person so offending.
