1139.02  USES.
   Within the N-C: Neighborhood-Commercial District, the following uses are permitted:
   (a)   Permitted Uses:
      (1)   Single Family Dwellings.
      (2)   Two Family Dwellings.
      (3)   Businesses engaged in the preparation and processing of food and drink to be retailed on the premises, such as bakeries, meat market, delicatessens and grocery stores.
      (4)   Businesses engaged in the sale of clothing and apparel; shoe and variety store; art, photo, stationery, notion, hobby, toy, book, music, floral, jewelry, gift sales and interior decorating offices.
      (5)   Doctor and dentist offices.
      (6)   General, professional, and administrative offices such as those used by architects, engineers, attorneys, accountants, realtors, financial planners, insurance companies, social and charitable organizations.
      (7)   Businesses providing personal services such as barber and beauty shops, tailor, dressmaker, shoe repair, laundries and dry cleaning.
      (8)   Accessory buildings incidental to the principal use which do not include any activity conducted as a business.
      (9)   Bicycle shops, copy centers, and antique stores.

   (b)   Conditionally Permitted Uses:  The Planning Commission may issue Conditional Zoning Certificates for uses listed herein, subject to the general requirements of Chapter 1113 and to any specific requirements of Chapter 1171 that do not contravene the general purpose of this Chapter.
      (1)   Churches and other buildings used for religious worship subject to Section 1171.01 (3), (7), (11), (14) and (17)
      (2)   Public and parochial schools subject to Section 1171.01(2), (3), (5), (6), (11)
      (3)   Governmentally owned and/or operated parks and playgrounds subject to Section 1171.01(2), (5), (11), and (17).
      (4)   Bed & Breakfast facilities subject to Section 1171.01(52)
      (5)   Home Occupations subject to Section 1171.01 (19).
      (6)   Family care home subject to Section 1171.01 (2), (3), (5), (11), (17), and (48).
      (7)   Group home subject to Section 1171.01 (2), (3), (5), (11), (17) and (48).
      (8)   Multifamily residential dwelling units,  subject to Section 1171.01 (35) and (47).
      (9)   Governmentally owned and/or operated buildings or facilities subject to Section 1171.01(3), (7), (8) and (11).
      (10)   Restaurants, but excluding those with drive-thru facilities, subject to Section 1171.01(2), (4), (5), (7), (9), (11), (34), (35), (36), (38), (39), and (40).
      (11)   Theaters, dance studios and schools, art galleries and museums subject to Section 1171.01 (7) and (36).
      (12)   Banks and financial institutions and Automatic Teller Machines excluding those with drive through facilities - subject to Section 1171.01 (4), (10), (the first sentence of section 46).
      (13)   Child day care facilities - subject to Section 1171.01 (2), (3), (5), (11), (17), (54).
