149.06 LAID-OFF EMPLOYEES WHO RETIRE; SICK LEAVE.
   Whenever an employee of the City is laid off from his or her employment with the City and, at the time of such layoff, has sufficient length of public service employment to entitle such employee to receive retirement benefits from the Public Employees Retirement System of the State and otherwise to meet the requirements of the then current payroll ordinance, such employee shall, provided he or she elects so to do before being recalled from layoff, have the right to retire and sell back accrued sick leave according to the formula which exists on the date of the employee's last day of work with the City.
   This provision shall be presumed to apply to all layoffs beginning on or after January 1, 1979. (Ord. 1980-155. Passed 10-1-80.)
