§ 50.99  PENALTY.
   (A)   Any person who violates any provision of this chapter for which no other specific penalty has been provided shall be subject to the penalties described in § 10.99 of this code of ordinances.
   (B)   (1)   Any person, firm or corporation violating any provisions of §§ 50.40 through 50.43 of this chapter (the Fats, Oil and Grease Control Ordinance) shall be subject to a civil penalty not to exceed $1,000 per day, plus costs outlined in the Fats, Oil and Grease (FOG) Enforcement Matrix.
         (a)   A citation for said civil penalty shall be issued by the Police Department.
         (b)   Each citation for a civil penalty must be paid within a specified number of days after issuance.
         (c)   Each and every day that the violation continues in violation of any provision of §§ 50.40 through 50.43 of this chapter shall be a separate and distinct offense.
      (2)   In addition to the Enforcement Matrix, the violator shall be responsible for the reimbursement to the town of all expenses that the town incurs due to the violation. These expenses include, but are not limited to, equipment cost, material cost, labor cost, for site remediation and cost recovery of a sanitary sewer overflow.
      (3)   The violator of shall also be responsible for all costs associated with a public or private penalty against the town due to any violation.
