3-1-1: DEFINITIONS:
When used in this chapter, the following words and terms shall have the meanings ascribed to them in this section:
ADULT ENTERTAINMENT AND ADULT ENTERTAINMENT FACILITY: Shall have the definitions set out in 65 Illinois Compiled Statutes 5/11-5-1.5 as of July 24, 1998, and, in addition thereto, shall include a bar, restaurant, cabaret or club wherein entertainers, or host, hostesses or managers, or waiters or waitresses, or any employee or customers appear in a state of nudity.
ALCOHOLIC LIQUOR: Shall include the following varieties of liquor, namely "alcohol", "spirits", "wine", "beer", and every liquid or solid, patented or not, containing alcohol, spirits, wine or beer, and capable of being consumed as a beverage by a human being, as the same are now defined by the Illinois Liquor Control Law, as amended and now in force, together with all regulations lawfully adopted and promulgated in the application and administration of said law.
BEER: A beverage obtained by alcoholic fermentation of any infusion or concoction of barley, or other grain, malt and hops in water, and includes, among other things, beer, ale, stout, lager beer, porter and the like.
LICENSEE: Includes the principal, proprietor, agent, servant or employee acting for and on behalf of said licensee.
PERSON: Includes any person, firm, copartnership, club or association.
PREMISES: When used to indicate the premises licensed by the City shall be defined as the entire permanent building or structure which contains a bar or bars, unless the license specifies a lesser portion of the building or structure, or unless the license specifically includes a permanent outdoor area meeting restrictions set out in subsection 3-1-9A of this chapter.
SELL AT RETAIL OR SALE AT RETAIL: Refers to sales for use and consumption and shall not refer to sales for the purpose of resale in any form.
SPECIAL EVENT: An event conducted by an educational, fraternal, political, civic, religious or nonprofit organization.
SPECIAL EVENT RETAILER: An educational, fraternal, political, civic, religious, or nonprofit organization which sells or offers for sale beer or wine, or both, only for consumption at the location and on the dates designated by a special event retail license.
STATE OF NUDITY: A state of dress or undress that exposes to view less than completely and opaquely covered human genitals, pubic region, buttocks, anus, or female breast below a point immediately above the top of the areola, but not including any portion of the cleavage of the female breast exhibited by a dress, blouse, shirt, leotard, bathing suit, or other wearing apparel, provided the areola is not exposed; or human genitals in a discernibly turgid state, even if completely and opaquely covered, or any device or covering that, when worn, simulates human male genitals in a discernibly turgid state.
WINE: Any alcoholic beverage obtained by the fermentation of the natural contents of fruits, or vegetables, containing sugar, including such beverages when fortified by addition of alcohol or spirits. (Ord. 2012-7, 12-10-2012; amd. 2018 Code)
