A. Generally: Every person adjudged guilty of violating any of the provisions of the Illinois Vehicle Code, as adopted herein, except 625 Illinois Compiled Statutes 5/11-501, and any provision of this title shall be fined not more than seven hundred fifty dollars ($750.00).
B. Driving Under The Influence:
1. Except as otherwise provided in this subsection B, any person convicted of violating 625 Illinois Compiled Statutes 5/11-501(a) is guilty of a Class A misdemeanor.
2. A person who violates 625 Illinois Compiled Statutes 5/11-501(a) or a similar provision a second time shall be sentenced to a mandatory minimum term of either five (5) days of imprisonment or two hundred forty (240) hours of community service in addition to any other criminal or administrative sanction.
3. A person who violates 625 Illinois Compiled Statutes 5/11-501(a) is subject to six (6) months of imprisonment, an additional mandatory minimum fine of one thousand dollars ($1,000.00), and twenty five (25) days of community service in a program benefiting children if the person was transporting a person under the age of sixteen (16) at the time of the violation.
4. A person who violates 625 Illinois Compiled Statutes 5/11-501(a) a first time, if the alcohol concentration in his or her blood, breath, or urine was 0.16 or more based on the definition of blood, breath, or urine units in 625 Illinois Compiled Statutes 5/11-501.2 shall be subject, in addition to any other penalty that may be imposed, to a mandatory minimum of one hundred (100) hours of community service and a mandatory minimum fine of five hundred dollars ($500.00).
5. A person who violates 625 Illinois Compiled Statutes 5/11-501(a) a second time, if at the time of the second violation the alcohol concentration in his or her blood, breath, or urine was 0.16 or more based on the definition of blood, breath, or urine units in 625 Illinois Compiled Statutes 5/11-501.2 shall be subject, in addition to any other penalty that may be imposed, to a mandatory minimum of two (2) days of imprisonment and a mandatory minimum fine of one thousand two hundred fifty dollars ($1,250.00).
C. Separate Offense: A separate offense shall be deemed committed for each day during which any violation of this title occurs, continues or is permitted. (Ord. 2013-2, 6-10-2013; amd. 2018 Code)
