§ 36.01  PROGRAM ADOPTION.
   The city developed this identity theft prevention program (“program”) pursuant to the Federal Trade Commission’s Red Flags Rule (“Rule”), (16 C.F.R. part 681, 15 U.S.C. § 1681m(e)), which implements § 114 of the Fair and Accurate Credit Transactions (FACT) Act of 2003 and ORS 646A.622, the state’s Consumer Identity Theft Protection Act, (OCITPA). This program was developed with oversight by the City Recorder and approval of the City Council. After consideration of the size and complexity of the utility’s operations and account systems, and the nature and scope of the utility’s activities, the City Council has determined that this program was appropriate for the city and, therefore, approved this program on 5-7-2009.
