(A) Application. This section shall apply to the following applications in residential districts:
(1) In the case of a request to divide a portion of a lot where the division is to permit the adding of a parcel of land to an abutting lot so that no additional lots are created and both new lots conform to Zoning Ordinance minimum lot size, setback and lot coverage standards;
(2) In the case of a request to combine 2 existing platted lots;
(3) To qualify, the parcel of land shall not have been part of a minor subdivision within the last 5 years;
(4) In the case of a request to divide a base lot which is a part of a recorded plat on which has been constructed a 2-family dwelling, townhouse or quadraminium, where the division is to permit individual private ownership of a single dwelling unit within such a structure and the newly created property lines will not cause any of the unit lots or the structure to be in violation of this chapter, the Zoning Ordinance, or the state’s Building Code.
(B) Content and data requirements.
(1) The requested minor subdivision shall be prepared by a registered land surveyor in the form of a certificate of survey.
(2) The data and supportive information detailing the proposed subdivision shall be as follows:
(a) Certificate of survey.
1. If the property affected is registered land, a Registered Land Survey shall be required. Ten copies of the survey (11” x 17”) and 1 reproducible copy (8-1/2” x 11”) shall be submitted to the City Administrator or designee not less than 2 weeks prior to the next Planning Commission meeting.
2. Contents of the certificate of survey shall include:
a. North arrow;
b. Lot sizes in square feet, prior to and after the proposed split;
c. Existing buildings and setbacks from proposed lot lines;
d. Tree cover;
e. Legal descriptions for the parcels to be created; and
f. Streets and easements.
(b) Additional information. In addition to the certificate of survey, the applicant shall submit:
1. A special assessment search;
2. Property owners’ names and addresses and proof of ownership;
3. Zoning of all affected parcels;
(c) The minor subdivision shall conform to all design standards as specified in this chapter. Any proposed deviation from said standards shall require the processing of a variance request.
(C) Processing of request for minor subdivision approval.
(1) All other minor subdivision requests shall be approved by the City Council following consultation with the Planning Commission. Upon review by the Planning Commission and/or City Council, the full platting process may be required if additional information is deemed necessary.
(2) Upon execution of the Council’s resolution approving the petition for a minor subdivision, the City Administrator shall be authorized to sign the deed or registered land survey as meeting the requirements of the city. The certificate of survey or Registered Land Survey shall be filed and recorded at the Office of the County Recorder within 30 days of approval.
(3) One digital copy of the minor subdivision shall be submitted to the city on disk.
