§ 71.12 MOTORIZED GOLF CARTS.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires different meaning.
      MOTORIZED GOLF CART. An electric or gas-powered vehicle with 4 wheels used primarily for light-terrain slow-moving or low-speed operation.
      SLOW MOVING VEHICLE EMBLEM. Placard described and attached to vehicle as listed in M.S. § 169.522.
   (B)   Operating provisions. It is lawful to operate a motorized golf cart upon city owned and maintained streets if the following criteria is met:
      (1)   The person has obtained a permit to operate the vehicle from the Chief of Police;
      (2)   The vehicle is equipped with slow-moving vehicle emblem;
      (3)   The vehicle is equipped with operational headlights, taillights, turn signals, and a rear-view mirror;
      (4)   The owner of the vehicle has obtained insurance for the vehicle in accordance with M.S. § 169.045.
   (C)   Restrictions. It shall be unlawful for any person to operate a motorized golf cart:
      (1)   At a speed greater than 12 mph;
      (2)   On any United States trunk highway, Minnesota state highway, or county state aid highway;
      (3)   On Sunset Drive from Aberdeen Avenue to 2nd Street and on Hillside Drive from Sunset Drive to Cedar Lane Drive;
      (4)   On any portion of the roadway other than as close to the right-hand curb as possible, except when the driver is making a left-hand turn;
      (5)   In a careless or reckless manner;
      (6)   From ½ hour prior to sundown to sunrise;
      (7)   In violation of any state traffic law when applicable.
   (D)   Private roadways. Nothing in this section shall prohibit the owner of real property used by the public for the purposes of vehicular travel from prohibiting the use, or requiring different or additional restrictions than those specified in this section or state statute.
   (E)   Permit process. To obtain a permit an individual must be at least 16 years old, possess a valid driver's license, and pay a permit fee as determined in the annual fee schedule. Permits shall be granted by the Chief of Police for a period of 1 year and may be renewed. All permits will expire on March 31 of each year. It is the responsibility of each permit holder to apply for renewal as necessary. The city is not responsible for providing permit holders with renewal reminders.
