§ 154.340 GROUNDWATER.
   (A)   Purpose. It is the intent of the city to:
      (1)   Support identification and reduction of groundwater contamination from both point and nonpoint sources.
      (2)   Support enforcement of County ISTS and community septic system ordinances.
      (3)   Continue to support programs that promote efficient administration of groundwater pollution programs.
      (4)   To target high priority water bodies for water quality projects: including working with those waters listed as "impaired" by the MPCA for listing under Section 303(d) of the Clean Water Act. These include waters listed for excess nutrients and fecal coliform bacteria where failing ISTS systems and contaminated groundwater contribute to the impairment.
   (B)   Regulation. The City of Jordan shall require all known non-compliant ISTS in the 10-year capture area of wellhead protection areas (WHPA) to be upgraded to conform to Minnesota Administrative Rule 7080 within 3 years of August 9, 2006 or within 3 years of establishment of a WHPA.
   (C)   Exceptions. An exception may be granted by the City of Jordan where non-compliant systems shall be provided with municipal sewer service within 5 years. However, in no case should noncompliant systems remain in violation for more than 5 years from August 9, 2006 or 5 years of establishment of a WHPA.
