§ 111.33 HOURS AND DAYS OF SALE.
   (A)   The hours of operation and days of sale shall be those set by M.S. § 340A.504, as it may be amended from time to time, except that the City Council may, by resolution or ordinance, provide for more restrictive hours than state law allows.
   (B)   No person shall consume nor shall any on-sale licensee permit any consumption of intoxicating liquor or 3.2 percent malt liquor in an on-sale licensed premises more than 30 minutes after the time when a sale can legally occur.
   (C)   No on-sale licensee shall permit any glass, bottle, or other container containing intoxicating liquor or 3.2 percent malt liquor to remain upon any table, bar, stool, or other place where customers are served, more than 30 minutes after the time when a sale can legally occur.
   (D)   No person, other than the licensee and any employee, shall remain on the on-sale licensed premises more than 30 minutes after the time when a sale can legally occur.
   (E)   The electorate of the city having heretofore authorized the same at a general or special election, a Sunday on-sale liquor license may be issued to hotels, restaurants, clubs or bowling centers, in conjunction with the sale of food, which have on-sale liquor licenses and which also have seating capacity for not less than 30 guests at one time. Prior to issuance of the license, the applicant shall provide the city with proof of financial responsibility for Sunday sales. The hours of Sunday on-sale liquor sales shall be from 12:00 p.m. to 1:00 a.m. Monday morning when New Year’s Eve falls on a Sunday; provided that the licensee is in conformance with the Minnesota Clean Air Act.
   (F)   Sales after 1:00 a.m.; permit fee.
      (1)   No licensee may sell intoxicating liquor or 3.2 percent malt liquor on-sale between the hours of 1:00 a.m. and 2:00 a.m., except on Saturdays and Sundays unless the licensee has obtained a permit from the commissioner and the City Council. Intoxicating liquor and 3.2 percent malt liquor on-sale shall be allowed on Saturdays, Sundays, and on New Year's Eve until 2:00 a.m. provided the establishment has obtained a 2:00 a.m. license from the State of Minnesota and provided a current copy of same to the city. The city reserves the right to modify the allowed times of sales at any time.
      (2)   The city may issue permits for sales between 1:00 a.m. and 2:00 a.m. for special events only held on Monday through Friday. A licensee must complete an application for a special event sales permit provided by the city. The City Council will consider each application individually at a public hearing. A special event sales permit shall only be valid for the specific dates for which the permit is issued. Each event requires a special event and hearing.

   (G)   Any violation of any condition of this section may be grounds for revocation or suspension of the license.
