§ 154.126 DESIGN AND PERFORMANCE STANDARDS (SEE TABLE B, RESIDENTIAL DESIGN AND PERFORMANCE STANDARDS TABLE).
   The design and performance standards are established to encourage a high standard of development by providing assurance that land uses will be compatible. The performance standards are designed to prevent and eliminate those conditions which depreciate property values that cause blight or are detrimental to the environment. Before any building permit is approved, the Zoning Administrator shall determine whether the proposed use will conform to the design and performance standards. The applicant or owner shall supply data necessary to demonstrate such conformance.
   (A)   All structures and land shall meet the requirements set forth in the City Code and amendments thereto relating to manufactured home parks.
   (B)   Noise. It is unlawful to make, continue or cause to be made or continued, any noise in excess of the noise levels set forth in Minnesota Rules 7030.0040, which includes standards for activities by the noise area classification (NAC) system, established in part by Minnesota Rules 7030.0050, unless such noise be reasonably necessary to the preservation of life, health, safety or property. Sounds in excess of these limitations are violations of this section whether the sound originates in a residential district or any other district.
   (C)   Required parking. Development and modifications to all parcels and buildings are subject to the provisions on off-street parking and loading spaces.
   (D)   Signs. Development and modification to all parcels, street uses and buildings are subject to §§ 154.241 through 154.260 Signs.
   (E)   Architecture and materials. Development and modification to all parcels, structures and buildings are subject to the provision on architectural control and building materials.
   (F)   Total land area required. Minimum total park area shall be 5 acres and not less than 250 feet in width.
   (G)   Distinctive design elements and/or themes common throughout the manufactured home park are strongly encouraged.
   (H)   All manufactured homes shall be properly connected to the municipal water supply and the municipal sanitary sewer system. All water and sewer systems shall be constructed in accordance with plans and specifications approved by the Planning Commission and City Council.
   (I)   The City shall determine/approve ingress and egress (including the number of ingress/egress points) to manufactured home parks. Access from a roadway supervised by another political subdivision shall be approved in writing by the applicable political subdivision. Said ingress and egress to manufactured home parks shall be designed to minimize congestion and hazards and allow free movement of traffic on adjacent streets. Distinctive design elements/themes are strongly encouraged for manufactured park entrances.
   (J)   Internal streets. Roadways shall be of adequate width to accommodate anticipated traffic, and in any case shall meet the following minimum requirements:
      (1)   All internal streets shall be a minimum of 24 feet in width from face-of-curb to face-of-curb with no parking signs posted by the manufactured park owner.
      (2)   All streets shall be provided with a paved concrete or bituminous surface. Pavement edges shall be protected to prevent raveling of the wearing surface and shifting of the pavement base as required by the city.
      (3)   Street surfaces shall be maintained, free of cracks, holes and other hazards.
      (4)   Maximum speed limits within the park shall not exceed 10 miles per hour.
      (5)   No parking shall be allowed on internal streets.
      (6)   Dead-end streets shall be prohibited, except cul-de-sacs.
      (7)   All streets should be posted with no parking signs.
   (K)   Open space required. A minimum of 500 square feet per manufactured home lot shall be provided for definable play areas with playground facilities/features and open space within the manufactured home park. Such areas of open space and/or play area shall not be areas included within any setback nor shall they include any areas of less than 20 feet in length or width. Open space areas are subject to approval by the city. The city may reduce the play area square footage requirement by a maximum of 30% of the total square feet required, if the park owner/developer installs trail facilities within the manufactured home park.
   (L)   Off-street overload parking required. Each manufactured home park shall maintain off-street overload parking lot for guests of occupants in the amount of 1 space for each 3 sites. Overload parking lots shall be located within 300 feet of the unit(s) to be served and in compliance with the parking lots standards contained in §§ 154.221 through 154.230.
   (M)   Patio required. Each manufactured home lot shall have a 4-inch thick concrete patio with a minimum total square footage of 150 feet shall be required. All sides of the patio shall exceed 9 feet in length.
   (N)   Pedestrian access required. All parks shall be provided with safe convenient all-season pedestrian access of adequate width for intended use, durable and convenient to maintain, between individual manufactured homes, the park streets and all community facilities provided for park residents. A common walk system shall be provided and maintained between locations where pedestrian traffic is concentrated. Such common walks shall have a minimum width of 4½ feet and shall be located on at least 1 side of the street. All manufactured homes shall be connected to common walks, to paved streets, or to paved driveways or parking spaces connecting to a paved street. Such individual walks shall have a minimum width of 2 feet. Common walkways shall connect to municipal trails where feasible.
   (O)   Tree planting required. A minimum of 1 tree per lot shall be required. In open area and park area, a minimum of 20 trees per acre is required. Tree varieties shall be native to the Jordan area. Trees shall be bound and burlapped with a minimum trunk diameter of 2 inches. Tree varieties and sizes proposed are subject to approval by the city.
   (P)   Storm shelter plan required.  All manufactured home parks shall provide a storm shelter or a plan of evacuation and sheltering for all residents of the park in times of severe weather conditions such as tornadoes, high winds and floods in accordance with Minnesota Statutes. The plan shall be developed with the input and approval of the city and shall be posted at conspicuous locations throughout the park. The shelter must be available to all residents of the park at any time of the day or night.
   (Q)   The corners of each manufactured home lot shall be clearly marked.
   (R)   All utilities, such as sewer, water, fuel, electric, telephone and television antenna lead-ins, shall be buried to a depth specified by the City Engineer, and there shall be no overhead wires or support poles except those essential for street or other lighting purposes.
   (S)   Screening required. All manufactured home parks shall be screened along all manufactured home park property boundary lines separating the park from adjacent properties and/or right-of-ways. Landscaping requirements must comply with §§ 154.321 through 154.325 General Landscaping Requirements.
   (T)   A properly landscaped area shall be adequately maintained around all public areas, adjacent to all roadways and on each manufactured home lot.
   (U)   Every structure in the manufactured home park shall be developed and maintained in a safe, approved and substantial manner. The exterior of every such structure shall be kept in good repair. All of said structures must be constructed to meet existing City Code and state and federal law.
   (V)   Portable fire extinguishers rated for electrical and liquid fires shall be kept in all service buildings and other locations conveniently and readily accessible for use by all occupants.
   (W)   All structures shall require a building permit.
   (X)   It shall be the duty of the operator of the manufactured home park to keep a record of all homeowners and occupants located within the park. The park operator shall keep the record available for inspection at all times by authorized city officials and other public officials whose duty necessitates acquisition of the information contained in the record.
   (Y)   The operator of any manufactured home park or a duly authorized attendant and/or caretaker shall be responsible at all times for keeping the park, its facilities and equipment in a clean, orderly, operable and sanitary condition. An authorized attendant or caretaker shall remain within 25 miles of the manufactured home park at all times and shall be answerable, along with said operator, for the violation of any provisions of these regulations to which said operator is subject.
   (Z)   All land area shall be adequately drained, landscaped to control dust, clean and at all times free from refuse, garbage, rubbish or debris.
   (AA)   The storage, collection and disposal of refuse in the manufactured home park, storage areas, grounds, buildings and structures shall be so conducted as to avoid accumulations of debris and in a manner free of health hazards, rodent harborage, insect breeding, accident or fire hazards or air pollution.
   (BB)   The growth of brush, weeds and grass shall be controlled at all times.
   (CC)   All provisions of this section relative to accessory structures and outdoor storage shall be adhered to at all times.
   (DD)   Manufactured home parks may be subject to additional requirements contained in this section including, but not limited to the sections governing parking, home occupations, flood plain/shoreland, signs, etc.
   (EE)   Fences. Fences are permitted under the following conditions:
      (1)   The fence shall have a clearance of 2 inches from pre-existing grade to bottom of fence and shall not exceed 6 feet in height.
      (2)   The property owner shall sign a fence agreement with the City of Jordan.
      (3)   The fence shall not restrict or obstruct the flow of water.
      (4)   The fence shall be 20 feet away from the high water level (HWL) or outside of the drainage and utility easement whichever is closer to the property line.
      (5)   A fence shall not be located within a drainage and utility easement that has been identified as an emergency over flow easement (EOF) or access easement.
      (6)   No fence shall cause a visual obstruction to traffic.
      (7)   Fences are structures and shall require a permit with an approved property survey by a registered land surveyor.
      (8)   Fences shall meet all International Building Code requirements for such structures.
      (9)   Fences not exceeding 3½ feet in height may be constructed in any front yard setback area. No fences are allowed in the front yard setback area unless the fence is 3½ feet tall or less.
