§ 96.01 DEPARTMENT OF PARKS AND RECREATION.
   (A)   The Common Council hereby establishes the Department of Parks and Recreation.
   (B)   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      (1)   DEPARTMENT. The Department of Parks and Recreation of the city.
      (2)   PARK. Includes the land and water constituting all parks and other recreation areas within the jurisdiction of the Department.
      (3)   PARK BOARD. The Board of Parks and Recreation of the city.
   (C)   The Department shall be composed of the Park Board. The Park Board shall be composed of four members who shall be appointed by the Common Council on the basis of their interest in and knowledge of parks and recreation. No more than two members of the Park Board shall be members of the same political party.
   (D)   Each member of the Park Board shall be appointed for a four-year term, commencing on the first Monday in January. Each member shall continue in office until his or her successor is appointed and qualified.
   (E)   The Park Board shall elect a president and vice-president at its first meeting of each year. The vice-president shall act as president of the Park Board during the absence or disability of the president.
   (F)   The Park Board may perform all acts necessary to acquire and develop sites and facilities and to conduct programs generally understood to be park and recreation functions, and shall have all powers and duties listed in I.C. 36-10-3-11, as amended.
   (G)   The Park Board may create an advisory council and special committees composed of citizens interested in parks and recreation, in accordance with I.C. 36-10-3-17, as amended.
   (H)   (1)   The Park Board shall prepare and submit an annual budget.
      (2)   The Park Board may accept gifts, donations, and subsidies for park and recreation purposes.
      (3)   A special non-reverting fund shall be established and made available for expenditures for purposes specified by persons donating money to the Park Board.
