§ 52.45 AFTER HOURS WORK.
   (A)   All emergency call outs shall be made to the utility at (765) 667-9666 after hours from 4:00 p.m. to 7:00 a.m. Monday through Friday, all weekends and holidays entire 24-hour periods. There may be a fee for such call-outs.
   (B)   A utility service representative being dispatched for the following reasons will be considered on-call, after hours:
      (1)   A utility service representative being dispatched between the hours of 4:00 p.m. and 7:00 a.m. for the purpose of turning on or off water service or other water and/or sanitary problems at a private, industrial, or commercial property;
      (2)   Calls received after 4:00 p.m. on Friday and before 7:00 a.m. on Monday for the purpose of turning on or off water service and/or sanitary problems at a private, industrial, or commercial property;
      (3)   Calls received on a regularly scheduled holiday for the purpose of turning on or off water service or other water and/or sanitary problems at a private, industrial, or commercial property;
      (4)   There maybe a service charge based upon the rate ordinance for emergency call outs or after hours.
   (C)   The utility is the only authorized agent to turn water on or off at the water meter setting or curb stop. This will prevent any question as to the responsibility of any repair bills that may occur from broken meter setting valves or curb valves. A person attempting to turn water on or off from a curb valve or meter setting valve shall be responsible for any and all repair cost occurred from any damage to that valve, curb box, or meter setting.
   (D)   The minimum charges for after hour call outs for repairs on private, industrial, and commercial property is $25. The utility or Board of Public Works and Safety reserves the right to increase or waive this fee on a case-by-case basis, in order to recover labor and materials costs. The Board of Public Works and Safety during a regularly scheduled meeting must approve waiving this fee.
   (E)   This fee should be paid following the billing ordinance procedures. Failure to pay the fee shall constitute the water being turned off for a delinquent payment.
