§ 91.42 FEES TO PERPETUAL FUND.
   All monies received from the sale of cemetery graves, pursuant to § 91.40, as amended; received from grave opening charges, pursuant to § 91.41, as amended; and donations received for the care of the cemetery shall be deposited in a separate fund to be known as the City Cemetery Perpetual Fund and shall be used solely for the maintenance and care of the city cemetery. No monies may be removed from the fund, either income or principle, until the Fund reaches $25,000, at that time any funds over $25,000 may be spent for needed city cemetery maintenance and care. The $25,000 shall be maintained as an emergency fund in case of unforeseen events and may be used for such purposes with the City Council’s specific direction. The minimum $25,000 amount, if used, is to be restored to its minimum amount pursuant to the procedure provided in this section.
