In the event the property owner and/or the applicant file a timely appeal after issuance of the NOV, the JCMS4C shall conduct a due process hearing within a reasonable time after the filing. It shall take a majority of a quorum of the JCMS4C to make a final decision on the appeal and the JCMS4C shall make written findings of fact in support of its decision and issue same as the required for the NOV. The property owner and/or applicant shall have 30 days after issuance of the decision to appeal same to the Jessamine Circuit Court. Failure of the property owner and/or applicant to pursue any appeal shall render the decision by the Planning Commission, JCMS4C or circuit court final and enforceable.
