§ 50.08 SERVICE CHARGES AND BILLING.
   (A)   There is hereby imposed for the collection and disposal of solid waste for each dwelling unit a service collection charge to be collected by the city. The total fee for each dwelling unit shall be a line item charge on each residential utility bill and shall be established by a Solid Waste Rate ordinance. Any dwelling unit that has an exclusive water meter service shall pay the current ordinance residential rate for garbage collection. The privilege and responsibility for the collection and regulation of charges and fees belongs to the Wilmore City Council; said billing fee shall be subject to alteration according to city ordinances.
   (B)   The service collection charge for each commercial or business entity, industrial or agricultural establishment or private institution, will be determined by the city on the basis of quantity and characteristics of material, point of pickup and the time required to collect the solid waste, and shall be established by a Solid Waste Rate Ordinance.
   (C)   However, any commercial or business institution, industrial or agricultural establishment, or private institution that cannot negotiate what is felt to be a fair and equitable service collection charge may appeal to the Wilmore City Council. Should the City Council’s decision need to be appealed, the customer can request that the city provide an arbitrator to resolve the service fee. The arbitrator’s fee will be shared evenly between the two parties. Such arbitration shall be provided once each year and all pending requests will be resolved at that time and all decisions of the arbitration shall be binding on all parties.
   (D)   The privilege and responsibility of regulating and collecting such service collection charges for each commercial or business entity, industrial or agricultural establishment, or private institution belong to the city. Any increase in residential service charges must be submitted to and approved by the Wilmore City Council under the rules and regulations thereby governing.
