§ 32.15 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AGREEMENT. This subchapter, the Commonwealth of Kentucky Statewide Emergency Management Mutual Aid and Assistance Agreement.
   AID AND ASSISTANCE. Personnel, equipment, facilities, services, supplies and other resources.
   AUTHORIZED REPRESENTATIVE. A party's employee, who has been authorized in writing by that party to request, to offer or to otherwise provide assistance under the terms of this agreement. The list of AUTHORIZED REPRESENTATIVES for each party executing this agreement shall be attached to the executed copy of this agreement. In the event of a change in personnel, unless otherwise notified, the presumption will be that the successor to that position will be the AUTHORIZED REPRESENTATIVE.
   DECLARED EMERGENCY. Any incident or situation declared to be to be an emergency by executive order of the Governor, a county judge/executive, a mayor, or the chief executive of other local governments in the Commonwealth pursuant to the provisions of KRS Chapters 39A to 39F.
   DISASTER. An occurrence or imminent threat of widespread or severe damage, injury or loss of life or property, resulting from any natural or manmade accidental, military or paramilitary cause.
   LOCAL AGENCY. A county, special district or city charged with coordination of all emergency management activities for its geographical limits.
   LOCAL EMERGENCY DECLARATION. An instrument signed by competent authority for any incident or emergency situation deemed to be beyond the capability of the county, special district or city charged with emergency response activities for its geographical limits.
   PARTY. A governmental entity which has adopted and executed this agreement. This may mean any general or special-purpose unit of government created and existing pursuant to the Kentucky Revised Statutes with the express power and authority to contract and be contracted with.
   PROVIDER. The party which has received a request to furnish aid and assistance from another party in need (the recipient).
   RECIPIENT. The party setting forth a request for aid and assistance to another party (the provider).
