§ 130.99 PENALTY.
   (A)   Any custodian allowing a minor to violate any provision of §§ 130.15 through 130.19 shall be subject to a fine of not more than $500 for each violation or imprisonment for a period not to exceed 6 months.
   (B)   Any person who violates any provision of § 130.01 shall be guilty of a Class B misdemeanor and shall be subject to a fine as provided by the Kentucky Revised Statutes for a Class B misdemeanor.
   (C)   The penalties for violation of §§ 130.30 through 130.33 shall be as follows:
      (1)   For the first violation, a Class B misdemeanor constituting a fine not exceeding $250, and/or up to 90 days in jail; in addition to response recovery cost for law enforcement services including the cost of personnel and equipment.
      (2)   For subsequent violation within 5 years, a fine of not more than $500 and/or not more than 12 months in jail; in addition to response recovery cost for law enforcement services including, the cost of personnel and equipment.
      (3)   If the person responsible for the party, gathering or event is an underage drinker or a juvenile, then the parents or guardians of that underage drinker or juvenile may be jointly and severally liable for the law enforcements services fee, if said party or gathering is held on the parents’ or guardians’ property and they knew or should have known that the party was taking place, and other penalties specified in this section
