No crossing, cutting or excavation affecting the county road system and right-of-way shall be made without the prior permission of the Fiscal Court except in the event of an emergency affecting the health and safety of the general public, in which case the County Judge/Executive shall be authorized to permit only such crossing, cutting or excavation as the emergency requires, with the crossing to conform to the methods as adopted by the Kentucky Department of Transportation and attached to the ordinance establishing this section, which attachment is adopted by reference herein as if copied in length, or any other method specifically approved by the Fiscal Court; and that any utility or other agency or person shall be subject to the condition that it must remove at any time, at expense of the agency, the utility property located in the right-of-way using the road right-of-way with a surety bond as the Fiscal Court may require in light of the type of construction requested.
