§ 36.096 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COMMERCIAL. A place for the exchange or buying and selling of merchandise.
   CONSTRUCTION. Any new structure built or any significant addition.
   DEVELOPMENT. Any human-made change to improved or unimproved real estate, including, but not limited to, buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations or storage of equipment or materials, including maintenance.
   FLOODPLAIN and SPECIAL FLOOD HAZARD AREA (SFHA). Those lands within the jurisdiction of the county that are subject to inundation by the base flood.
      (1)   The FLOODPLAINS of the Macoupin Creek, Mill Creek, Phils Creek, Piasa Creek, Otter Creek, Illinois and Mississippi Rivers are generally identified as such on the flood insurance rate map of the county prepared by the Federal Emergency Management Agency and dated April 2, 2009.
      (2)   FLOODPLAIN also includes those areas of known flooding as identified by the community.
   RESIDENTIAL. The place where one lives; a building used as a home.
   SUBSTANTIAL DAMAGE. Damage of any origin sustained by a structure whereby the cost of restoring the structure to its before damage condition would equal or exceed 50% of the market value of the structure before the damage occurred regardless of actual repair work performed.
      (1)   Volunteer labor and materials must be included in this determination.
      (2)   Damage of less than 50% of the fair market value will be applied to the repetitive loss calculations.
   SUBSTANTIAL IMPROVEMENT.
      (1)   Any reconstruction, rehabilitation, addition or improvement of a structure, the cost of which equals or exceeds 50% of the market value of the structure before the improvement or repair is started. SUBSTANTIAL IMPROVEMENT is considered to occur when the first alteration of any wall, ceiling, floor or other structural part of the building commences, whether or not that alteration affects the external dimensions of the structure.
      (2)   The term does not, however, include either:
         (a)   Any project for improvement of a structure to comply with existing state or local health, sanitary or safety code specifications which are solely necessary to assure safe living conditions; or
         (b)   Any alteration of a structure listed on the National Register of Historic Places or the Illinois Register of Historic Places.
