4.08.020: DUTIES AND PURPOSES:
The duties and purposes of the Developer Reimbursement Commission shall be as follows:
A.   Administer the Council approved resolution for the amounts, methods and procedures for reimbursement of costs to private initial developers who have installed public works infrastructure improvements by any subsequent developers or property owners that connect to those systems.
B.   The Office of the City Engineer shall prepare and maintain a system to track all public works improvements by initial developers subject to reimbursement.
C.   The commission shall accept requests for reimbursement, to include actual receipted costs and plans, from the initial developer that has installed public works infrastructure improvements to be paid back by any subsequent developers or property owners who utilize same infrastructure improvements.
D.   With the assistance of the Office of the City Engineer, establish the boundaries of properties that will be required to reimburse the initial developer that installed the public works infrastructure improvements, and notify owners of those properties of the requirement to reimburse the initial developer when and if their properties eventually develop and utilize same public works infrastructure improvements.
E.   Using cost information from the developer that installed the public works improvements or other approved methods, determine the proper compensation that any developer or property owner that connects the public works infrastructure will be required to pay.
F.   Verify that the reimbursement has been made to the initial developer that installed the public works infrastructure improvements by any subsequent developer or property owner that connects to those systems. (Ord. 1164, 2017)
