13.32.030: DELIVERY DEVICES TO BE FURNISHED BY CITY:
Head gates, weirs, delivery boxes or other measuring or delivery devices for the delivery or measurement to individual users of irrigation water shall be paid for by the city. Installation of the irrigation measuring or delivery devices shall be paid for by the city of Jerome, and the city of Jerome shall be responsible to keep the irrigation measuring or delivery devices in repair. The duty of the city to keep the measuring and delivery devices in repair shall not prevent the city from seeking recovery of the costs of repairs from responsible parties who may intentionally or negligently damage those devices. In the event a property owner fails to repair head gates, weirs, delivery boxes or other measuring or delivery devices intentionally or negligently damaged by the property owner, his family, contractors or invitees, the city shall refuse to deliver irrigation water to such property owner until the necessary repairs have been made by the property owner.
