The registered owner of the truck, semitrailer or truck-tractor shall be presumed to be in control of the equipment found to be in violation of this chapter, and subject to the penalty therefor. Provided, however, that no such presumption shall apply where the owner demonstrates the equipment illegally parked was placed there without the consent, express or implied, of the owner.
