A. Penalty Payment: A single violation of this chapter shall be punishable by a civil penalty in the amount of twenty dollars ($20.00). A person who has received a notice of violation under this chapter signed by a law enforcement officer may pay the civil penalty, within ten (10) calendar days of its receipt, at the office of the city clerk, or by mailing the final amount to the office of the city clerk, as directed on the notice of violation. Alternatively, the person receiving the notice of violation may contest the violation by appearing before an officer of the city of Jerome police department designated by the chief of police at the time, date, and place contained in the notice of violation. This officer shall be designated the review officer. The review officer shall not be the officer who issued the notice of violation.
B. Proceedings Before Review Officer: The review officer may take statements from the officer issuing the notice of violation and the person requesting a review, and, in the review officer's discretion, may then dismiss or affirm the notice of violation. If the notice of violation is affirmed, the payment of the civil penalty shall be immediately due and payable.
C. Failure To Pay Penalty: Any person who fails to pay a civil penalty due under this section shall be guilty of an infraction. The civil penalty for failing to pay a civil penalty under subsection A or B of this section shall be one hundred dollars ($100.00). The person who is alleged to have failed to pay a civil penalty shall be issued a uniform citation charging a violation of this section.
D. Form Of Notice Of Violation: Any person alleged to have committed a violation of this chapter shall receive a notice of violation in a form substantially as follows:
