A. It is unlawful for any person except a physician, dentist, podiatrist, osteopath, pharmacist, registered nurse, wholesaler or manufacturer acting within the scope of his profession or occupation to possess drugs required by the laws of this state or of the United States, or by the rules and regulations of the state board of pharmacy or its successors of the state, to be sold on prescription order, without a valid prescription from a licensed physician, dentist, podiatrist, osteopath, pharmacist, registered nurse, wholesaler or manufacturer.
B. Any person violating the provisions of this chapter shall be guilty of a misdemeanor and shall be punished by imprisonment in the county jail not exceeding six (6) months or by a fine not exceeding three hundred dollars ($300.00) or by both. (Prior code §17-15.1)
