8.04.150: DISTRIBUTION OF ADVERTISING MATTER:
A.   It is unlawful for any person to distribute, hand out or discard, or cause to be distributed, handed out or discarded, any handbill, circular, poster, card or other advertising material or matter, or wastepaper, garbage or rubbish, in, upon or about, any of the streets, alleys, sidewalks, avenues or other public places, or in or upon any motor vehicle, or in open spaces or in vacant lots, or in yards or stoop of privately owned premises, within the boundaries of the city; provided, however, that it shall not be unlawful to distribute newspapers capable of being entered in the mail as second class mail matter or to distribute in the above prescribed manner any matter having as its primary content and purpose a noncommercial message; provided further, that the presence of any handbill, circular, poster, card or other advertising material or matter upon or in any of the here and before designated prohibited places shall be prima facie evidence of the fact that the same was caused to be distributed, handed out or discarded by the person, whose name appears thereon as a sponsor thereof.
B.   The foregoing provisions, however, shall not be construed as making it unlawful to hand out personally to owners or occupants of private premises, parts of private premises, any advertising material or matters. (Ord. 714 §1, 1989: Ord. 627(SS), 1980: prior code §9-14)
