8.04.070: RECEPTACLES; GENERAL REQUIREMENTS:
A.   Each householder, head of a family, tenant, proprietor or operator of a place of business within the city, who is in possession of, or in charge of, any premises within the city upon which garbage or rubbish accumulates or may accumulate, shall provide and maintain upon such premises at a place not exceeding five feet (5') from the alley line of such premises where such premises are adjacent to an alley, and where the same may be conveniently picked up and emptied by the garbage and rubbish collector of the city, a metal or plastic watertight regulation garbage can, rodentproof, with two (2) handles that can be grasped when the can is upside down in the dumping process, a capacity of not less than five (5) gallons and not to exceed thirty (30) gallons, with a flytight cover which shall be in place at all times except when garbage or rubbish is being deposited therein or removed therefrom, and kept free from offensive odors and in such condition that all garbage and rubbish will readily pour therefrom. Each such householder, head of a family, tenant, proprietor or operator, shall deposit all "garbage" and "rubbish", as defined in section 8.08.010 of this title, accumulating upon such premises, in such receptacles as fast as the same accumulates. No fire shall be lighted in such receptacle in violation of state law or state health department regulation.
B.   Boxes, paper, tree cuttings and all odd articles shall be crushed or bundled in lengths not to exceed five feet (5') and not to exceed fifty (50) pounds in weight; except, that articles may be taken in special hauls by special arrangements with the garbage and rubbish collector. Dirt and debris from construction or lawn renovation, and other refuse are not acceptable for collection. Nevertheless, no property owner or occupant of real property within the city shall permit the presence or accumulation of refuse on real property owned or occupied by that person.
