§ 31.38  REDEVELOPMENT COMMISSION.
   (A)   There is hereby established the Department of Redevelopment. The Department will be controlled by a board of five members known as the Jennings County Redevelopment Commission. Three members shall be appointed by the Board of Commissioners and two members shall be appointed by the County Council pursuant to I.C. 36-7-14-16.1.
   (B)   The Board of Commissioners shall also appoint an individual to serve as a nonvoting advisor to the Department of Redevelopment. The nonvoting advisor appointed under I.C. 36-7-14-16.1 must also be a member of the School Board Corporation that includes all or part of the territory served by the Redevelopment Commission or an individual recommended by the School Board to the entity that appoints the nonvoting advisor. Additionally, the nonvoting advisor is not considered a member of the Redevelopment Commission for purposes of this section, but is entitled to attend and participate in the proceedings of all meetings of the Redevelopment Commission; is not entitled to a salary, per diem, or reimbursement of expenses; serves for a term of two years and until a successor is appointed; and serves at the pleasure of the entity that appointed the nonvoting advisor.
   (C)   Each Redevelopment Commissioner shall serve for one year, from the first day of January after his or her appointment, until his or her successor is appointed and has qualified, except that original Commissioners shall serve from the date of their appointment until the first day of January in the second year after the appointment. If a vacancy occurs, a successor shall be appointed in the same manner as the original Commissioner, and the successor shall serve for the remainder of the vacated term.
   (D)   Pursuant to I.C. 36-7-14 and 36-7-25, all of the territory within the boundaries of the county, except the territory within the corporate boundaries of the City of North Vernon, will be a taxing district to be known as the Redevelopment District of Jennings County, for the purpose of levying and collecting special benefit taxes for redevelopment purposes. All of the taxable property within this special taxing district will be considered to be benefitted by the redevelopment projects and economic development projects carried out under this section to the extent of the special taxes levied hereunder.
