§ 154.999  PENALTY.
   (A)   Violation of chapter. Any person, firm or corporation who violates any provision of this chapter shall be liable for a penal fine and the penalty shall be a fine as set by the Board and/or Council from time to time, and each day that a violation is permitted to continue shall constitute a separate offense. In addition, violators shall be subject to reimbursement to Area Plan Commission of all costs, including legal fees, of enforcement herein.
      (1)   Any structure erected, raised or converted, or land or premises used in violation of any provision of this chapter is hereby declared to be a common nuisance, and the owner of such structure, land or premises shall be liable for maintaining a common nuisance.
      (2)   The Board of Zoning Appeals, Area Plan Commission or the Zoning Enforcement Officer may institute a suit for injunction in the Circuit Court to restrain any person, firm or corporation or a governmental unit from violating the provisions of this chapter.
      (3)   The Board of Zoning Appeals or Area Plan Commission may institute a suit for a mandatory injunction in the Circuit Court directing an individual, firm, corporation or governmental unit to remove a structure erected in violation of the provisions of this chapter.
   (B)   Penalty of non-licensed individuals. Any individual, firm, corporation or independent contractor doing electrical wiring, for hire/pay without an electrical license in violation of § 154.085 shall receive a fine as set by the Board and/or Council from time to time as set by the County of Jennings, City of North Vernon and Town of Vernon from time to time.
   (C)   Penalty for abandoned vehicles. Any person, firm or corporation violating any of the provisions of §§ 154.180 through 154.196 shall be guilty of an ordinance violation and, upon conviction, such violators shall be fined in a sum as set by the Board and/or Council from time to time.
