§ 33.49  HEALTH DEPARTMENT FEES.
   (A)   Authority to charge service fee plus costs for providing services. The County Health Department is hereby authorized to charge a service fee plus costs for providing to any person the following services:
      (1)   For any health services provided through the County Health Department including, but not limited to, injections and screenings;
      (2)   For services provided by the County Health Department in providing a copy of a certificate of birth and death;
      (3)   For services provided in home loan inspections including, but not limited to, waste water systems;
      (4)   For services provided in the inspection of public eating and drinking establishments, retail food markets, itinerant food stands and semi public food service establishments to obtain a permit for license for food markets and eating and drinking establishments in the county; and
      (5)   For supervision and inspection of sanitary installations as required by Chapter 52 of this code of ordinances, as the same is amended or may be amended from time to time.
   (B)   Fees schedule. The County Board of Health is hereby authorized to charge fees for the services described in division (A) above of this section based upon the following schedule:
      (1)   Food service establishment - permanent location. Fees as set by the Board and/or Council from time to time.
      (2)   Food markets. Fees as set by the Board and/or Council from time to time.
      (3)   Temporary food service.
         (a)   For each event of operation: a fee as set by the Board and/or Council from time to time per unit.
         (b)   Three or more events of operation in the county annual: a fee as set by the Board and/or Council from time to time.
         (c)   A separate license shall be required for each retail food establishment or temporary food establishment operated or to be operated by any person. A license issued under this section is not transferable.
         (d)   Establishment personnel certification fee: a fee as set by the Board and/or Council from time to time every three years.
      (4)   Minimum requirements for retail food establishments. All retail food establishments and vending machines shall comply with the minimum requirements specified by the State Department of Health Retail Food Establishment Sanitation Requirements in Title 410 I.A.C. 7-20, two copies of which are on file in the office of the County Clerk for public inspection.
      (5)   Organizations/non-profit organization. All organizations/non-profit organizations that are opened for more than 30 days of operation per year will be charged the minimum annual fee as set by the Board and/or Council from time to time.
      (6)   On-site waste water disposal. Permit fee.
         (a)   For repairs/replace: a fee as set by the Board and/or Council from time to time.
         (b)   For new: a fee as set by the Board and/or Council from time to time.
      (7)   Housing loan inspections. Pre-existing septic system inspection fee: a fee as set by the Board and/or Council from time to time.
      (8)   Certifications.  Septic contractor installers certification: a fee as set by the Board and/or Council from time to time per contractor/employee.
      (9)   Birth certificate.
         (a)   Regular: a fee as set by the Board and/or Council from time to time.
         (b)   Regular/laminated: a fee as set by the Board and/or Council from time to time.
      (10)   Death certificates.
         (a)   Certified copy: a fee as set by the Board and/or Council from time to time.
         (b)   Affidavit of amendment fee: a fee as set by the Board and/or Council from time to time (includes corrected birth certificates).
      (11)   Laminating.  Each item: a fee as set by the Board and/or Council from time to time.
      (12)   Injections.
         (a)   Hepatitis A and B: At cost (an administrative fee as set by the Board and/or Council from time to time will be added to the cost of the vaccine.)
         (b)   Flu: a fee as set by the Board and/or Council from time to time.
         (c)   Other injections: At cost (an administrative fee as set by the Board and/or Council from time to time will be added to the cost of the vaccine.)
      (13)   Screenings.
         (a)   PPD (TB skin testing): a fee as set by the Board and/or Council from time to time.
         (b)   Second PPD: a fee as set by the Board and/or Council from time to time.
         (c)   Cholesterol screening: a fee as set by the Board and/or Council from time to time.
   (C)   Collection, accounting, and disposition.
      (1)   Collection of fees. The County Health Department shall collect such fees in accordance with the schedule of fees shown in division (B) above of this section.
      (2)   Accounting for fees. All fees collected by the County Health Department shall be accounted for in detail for each program service area.
      (3)   Health service fees - other health jurisdictions. Fees collected for health services provided individuals and other units of government which involve costs for providing such services from the county tax revenue shall be collected in accordance with any contract or agreement which may be entered into from time to time between the County Health Department and other units of government, subject to approval of the Board of Commissioners.
      (4)   Exemption from compliance. An organization that is exempt from the state gross income tax under I.C. 6-2.1-3-20 through I.C. 6-2.1-3-22 and that offers food for sale to the final consumer at an event held for the benefit of the organization is exempt from complying with the requirements of this section that may be imposed upon the sale of food at that event if:
         (a)   Members of the organization prepare the food that will be sold;
         (b)   Events conducted by the organization under this section take place for no more than 30 days in any calendar year; and
         (c)   The name of each member who has prepared a food item is attached to the container in which the food item has been placed.
      (5)   Minimum requirements for retail food establishments. All retail food establishments and vending machines shall comply with the minimum requirements specified by the State Department of Health Retail Food Establishment Sanitation Requirements Title 410 I.A.C. 7-20, two copies of which are on file in the office of the County Auditor for public inspections.
