§ 33.46  JAIL PROCESSING FEE.
   (A)   Any person who is:
      (1)   Sentenced for a felony or a misdemeanor;
      (2)   Subject to lawful detention as defined in I.C. 35-41-l-18 in the county jail and is ordered to serve said detention on an intermittent basis; and
      (3)   Not detained as a child subject to the jurisdiction of a juvenile court;
Shall reimburse the county a sum, as shall be set by the Board and/or Council from time to time, each time the person checks into the county jail to serve any part of his or her intermittent detention.
   (B)   The County Sheriff shall collect the amounts due from a period under this section and deposit said funds into the Non-Reverting County Prisoner Reimbursement Fund.
   (C)   The County Sheriff shall provide to the County Council an annual report for the Non-Reverting County Prisoners Reimbursement Fund. This report is to be submitted at the regular scheduled meeting in February of each year reflecting the beginning balance, the ending balance, the receipts during the year and a summary of the disbursements during the year.
   (D)   All monies collected under this section shall be used for the purpose of funding courthouse security and general operating expenses of the jail.
