§ 33.45  INMATE MEDICAL CARE REIMBURSEMENT PROGRAM.
   (A)   Pursuant to I.C. 11-12-5-5, the Board of Commissioners hereby elects to implement the provisions of this program.
   (B)   Pursuant to I.C. 11-12-5-5(b) the Board of Commissioners shall set the following schedule of cost of co-payments and additional healthcare related services.
      (1)   Any inmate in the county jail will be charged rates as set by the Board and/or Council from time to time for routine medical care, including inmates who are being held out of county including State Department of Corrections holds, Immigration and Customs Enforcement (ICE) holds, and inmates serving weekend sentences.
      (2)   No charge for those supplying their own prescriptions after the initial set up fee. No charge for exams required by the jail.
      (3)   No one will be denied medical care due to the inability to pay at the time of service.
         (a)   A negative balance will be carried for a period of 60 days.
         (b)   A person who is subject to lawful detention and has private health coverage or Medicaid will be responsible for healthcare services rendered prior to and during incarceration.
         (c)   Specialty and non-emergency consults or follow up with ob/gyn, ortho, optometry, psychiatric, lab, x-ray and dental will be at actual cost unless otherwise ordered.
   (C)   Pursuant to I.C. 11-12-5-7(b) the courts may order persons meeting the criteria set forth in the program to execute a reimbursement plan and make repayments under the plan to the county for the costs permitted, as a term of the sentence imposed.
   (D)   Certain costs for emergency, non-emergency and specialty follow-up services provided to inmates may be subject to court order for reimbursement to the county as a term of sentencing.
   (E)   The Board of Commissioners hereby directs the County Sheriff to collect and account for the inmate medical cost reimbursement payments pursuant to this program.
   (F)   The Board of Commissioners hereby establishes a separate, non-reverting fund for the placement of the funds and court judgments collected pursuant to the program to be designated as the County Inmate Medical Care Reimbursement Program Fund. Said fund will be used for indirect costs of inmate care, purchase and replacement of durable medical equipment and to support state compliance to implement and maintain electronic medical records and items not covered in a current contract or reimbursed.
