(a) Whoever violates any provision of Chapter 678 of the Codified Ordinances of the Village of Jefferson, is guilty of one of the following:
(1) Except as otherwise provided in division (2) or (3) of this section, a minor misdemeanor;
(2) If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to a violation of any provision of Chapter 678 of the Codified Ordinances of the Village of Jefferson, a misdemeanor of the fourth degree;
(3) If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to two or more violations of any provision of Chapter 678 of the Codified Ordinances of the Village of Jefferson, a misdemeanor of the third degree;
(b) Whoever is convicted of or pleads guilty to a misdemeanor or minor misdemeanor shall be sentenced in accordance with § 698.02.
