(A) All revenues and fees collected for storm water service, including but not limited to storm water system user fees, penalties assessed by this chapter or subsequent amendments, or interest earned on any unused funds shall be deposited in an account entitled “City of Jasonville Storm Water Revenue Fund” and shall be subject to the provisions of I.C. 36-9-23, as amended. Funds from this account shall be accounted for as separate from other utility funds and shall not be comingled with the funds of any other city utility division or department or the General Fund of the city and shall not be transferred for any other purpose. To the extent that there are outstanding revenue bonds of the city issued pursuant to the provisions of I.C. 36-9-23, as amended, revenues deposited in the Storm Water Revenue Fund shall be subject to the covenants contained in the ordinance or ordinances authorizing such outstanding bonds.
(B) Disbursements from the Storm Water Revenue Fund shall be authorized by the Clerk-Treasurer and, as required by law, the Council. Such disbursements shall be used exclusively for the operation, maintenance, and improvement of the city’s Storm Water Subdivision, which uses include but are not limited to the following:
(1) Storm water management services, such as public education and outreach, studies, design, permit review, plan preparation, and development review;
(2) Operation, maintenance, repair, and replacement of the storm water collection, storage, conveyance, and/or treatment infrastructure;
(3) Project costs related to constructing major or minor structural improvements to the city’s storm water system;
(4) Administrative costs associated with the management of the Storm Water Subdivision;
(5) Debt service financing of the city’s storm water related capital improvements;
(6) Funding of studies such as water quality, quality monitoring, and aerial photography, all of which are associated with planning storm water related infrastructure; and
(7) Implementing long range storm water plans developed and approved by the State Department of Environmental Management for elimination of combined sewer overflows.
