For the purpose of this chapter, the following definitions shall apply; words used in the singular shall include the plural, and the plural, the singular; and words used in the present tense shall include the future tense. The word SHALL is mandatory and not discretionary. The word MAY is permissive. Words not defined herein shall be construed to have the meanings given by common and ordinary use as defined in the latest edition of Webster’s Dictionary.
APPROVED PLANS. Plans approved by the city according to a permit and plan review that govern all improvements made within the service area that require a storm water system or changes or alterations to the existing storm water system.
CITY. The City of Jasonville, acting by and through the Council.
COMMERCIAL PROPERTY. All properties within the service area not encompassed within the definition of residential property with water or sewer service intended to measure flow to/from the city’s utility service.
COUNCIL. The Common Council of the City of Jasonville, Indiana, or any other successor entity or any duly authorized officials acting on its behalf.
LOT. The smallest separately segregated parcel, unit, or plot of land having an identified owner, boundaries, and surface area that is documented for property tax purposes by the Greene County Assessor.
PERSON. Any individual, corporation, partnership, institution, or other entity deemed by the city to be the responsible party for any residential or commercial property.
RESIDENTIAL PROPERTY. Any lot or parcel existing in the service area on which reside one or two dwelling units.
SERVICE AREA. All property within the corporate boundary of the City of Jasonville, Greene County, Indiana.
STORM WATER. Water that originates during precipitation events including rain, snow, sleet, ice, or hail.
STORM WATER SYSTEM. All facilities constructed in an easement or right of way, including structures and natural watercourses under the ownership, and/or control of the city, used for collecting and conveying storm water to, through, and from drainage areas to the point of final outlet, including any and all of the following: inlets, creeks, channels, catch basins, ditches, streams, street culverts, retention or detention basins and pumping stations, private drainage systems, or drainage systems that are the responsibility of a homeowners’ association, and excluding therefrom any part of the system of drains and water courses under the jurisdiction of Greene County.
STORM WATER SYSTEMS also may include waters that are under the jurisdiction of various permitting agencies of the State of Indiana, which acts by and through the Indiana Department of Natural Resources and/or the Indiana Department of Environmental Management or the United States of America, which acts by and through the Corps of Engineers.
STORM WATER USER FEE. A charge imposed on users of the city’s storm water system.
SURFACE WATER. Water occurring on the surface of the land.
