§ 90.09 DANGEROUS ANIMALS.
   (A)   A dangerous animal is an animal that has previously attacked or bitten a person or animal, who is known by the owner to be potentially dangerous.
   (B)   An animal shall not be declared dangerous if the threat, injury, or damages was sustained by a person or animal who, at the time was unlawfully on the property, or, while lawfully on the property was tormenting, abusing, or assaulting the animal, it's owner, or another person rightfully on the property.
   (C)   An animal will not be declared dangerous if it is defending or protecting a human with the vicinity of the animal from an unjustified attack or assault.
   (D)   It shall be unlawful for any person owning or having possession of any dangerous animal to allow running at large, or recklessly, or negligently allow a dangerous animal to escape and become at large.
   (E)   Any person who violates the subsection of dangerous animals shall be assessed a fine of $100 per violation and the fee shall be paid to the City of Jasonville Clerk Treasurer within 14 days. Any person failing to pay said fee within the time frame will be turned over to the collection agent for the City of Jasonville.
