The following definitions shall apply to this chapter as written unless context indicates or requires a different meaning:
DWELLING(S). A residential structure used primarily as a place of abode for one or more persons, including multi-family houses (two-units or duplexes, three units or triplexes or four units or quadplexes). The collection of refuse and recyclables from multi-family structures will be based on a "per household" collection and billed separately.
DWELLING UNIT. A portion of a residential structure, used by one family for cooking, living, and sleeping purposes.
GARBAGE CONTAINER. A 96 gallon plastic container used for the placement of discarded household waste.
HAZARDOUS WASTE. Includes material or substance that is toxic or hazardous waste as defined in either the Solid Waste Disposal Act (42 U.S.C. § 691 et seq.) or in the Indiana Environmental Management Act (I.C. 13-11-1-1 et seq.), or special nuclear byproducts material within the meaning of the Atomic Energy Act of 1954.
HEAVY TRASH. Includes household furniture, mattresses, large toys, carpeting tied in three foot bundles or greater, and appliances not containing chlorofluorocarbons (“CFCs”) and hydrofluorocarbons (“HCFCs”) such as refrigerators and air conditioners. Specifically excluded are construction debris and items defined as YARD WASTE herein. Also excluded are televisions. HEAVY TRASH items shall not include items weighing in excess of 100 pounds.
HOUSEHOLD WASTE. Includes ordinary, non-hazardous household refuse, not requiring special handling such as garbage, rubbish and trash resulting from the normal operation and function of a household. It specifically includes kitchen wastes, cans, bottles, household food, vegetable matter attendant to preparation of foods, and accumulations of animal food. Also included are newspapers and magazines, discarded clothing and similar materials. It does not include material within the definition of "Heavy Trash" such as furniture or appliances. Expressly excluded from the definition of HOUSEHOLD WASTE are items defined herein as “yard waste,” construction debris, hazardous materials, including hazardous waste, human/animal excretions and carcasses.
RECYCLABLES. Includes newspaper, mixed paper (telephone books, cereal boxes, corrugated cardboard, magazines/catalogs, flyers, junk mail, stationary, office, and copy paper, paper grocery bags, computer paper) tin/steel/aluminum cans, plastic containers (#1 through #7, milk and beverage containers). Motor oil and other hazardous materials will not be a required recyclable to be picked up by the contractor. This list of recyclable materials may be expanded based on the existence of an established secondary market for a commodity.
RECYCLING CONTAINER. A 96 gallon plastic container used for the placement of discarded recyclables.
RESIDENTIAL PROPERTY. Includes single family dwelling units, multi-family dwelling units or mobile homes. It does not include business or professional establishments, apartment complexes, schools, motels or hotels.
YARD WASTE. Compostable organic waste resulting from the maintenance of lawns, gardens, landscaping, and trees which include grass clippings, tree branches and limbs, small plants and twigs.
