§ 94.01 UTILITY POLES.
   (A)   Whenever for the purpose of improving any property, public or private, or any streets, alleys, or public ways within the corporate limits of said city, it becomes necessary to remove any of the poles, wires, or any other fixtures to make such improvement and the removal thereof is ordered by the Common Council, the same shall be done by and at the expense of the said companies within five days after written notice by the Mayor to remove the same.

   (B)   If said companies fail, refuse, and neglect to comply with the order of the Common Council to remove its poles or wires for the purpose above specified, then and in that case the city or private individual is hereby granted the right to remove said poles, wires, or other fixtures, and the company violating the order to move said fixtures shall pay the cost of moving.
