§ 91.50 DECLARATION OF PUBLIC NUISANCE.
   The mining of coal within the corporate limits of the city by what is known as the strip mining method of removing the surface soil from coal is injurious to the public health and safety within said city, is offensive to the senses, essentially interferes with the free use of property and the comfortable enjoyment of life and property, and is hereby declared to be and constitute a public nuisance and unlawful.
