§ 91.30 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   GRASS. Any of various green plants having simple leaves and generally cultivated for lawns, but excluding agricultural crops such as hay and pasture.
   OWNER. The record owner of the affected real property as reflected in the office of the County Auditor.
   RANK VEGETATION. The uncontrolled growth of any grass, weed or other plant beyond nine inches in height (excluding trees, flowers, ornamental shrubs and plants, and agricultural crops such as hay and pasture), as well as the following conditions:
      (1)   Noxious weeds and detrimental plants as defined by I.C. Title 15, grass over nine inches in height and any other plant, weed or rank vegetation over nine inches in height, which are not mowed at least once a month in April and October, and at least twice a month during the months of May through September;
      (2)   Trees, limbs, branches, shrubbery or other vegetation with less than 14 feet clearance over, along and across streets or alley ways, or less than eight feet clearance over, along or across the sidewalks;
      (3)   Trees, limbs, branches,: shrubbery or other vegetation that prevents adequate visibility at street and alley intersections or which blocks the view of any street or traffic sign, signal or device;
      (4)   Shrubbery or vegetation in excess of three feet in height within a radius of 20 feet from the point where the curb line of any street intersects the curb line of another street;
      (5)   Trees, limbs, branches, shrubbery or other vegetation, which interferes with street lights or the convenient maintenance of street lights, or obstructs the light from street lights;
      (6)   Any trees, shrubbery or unauthorized vegetation planted within the public right-of-way of any street, alley or public way; and
      (7)   Trees, limbs, branches, shrubbery or other vegetation which creates or constitutes a hazard to the pedestrians, persons passing by or the public.
   WEEDS. Any uncultivated plants occurring naturally which have a tendency to dominate or drive out grasses or other cultivated plants, but does not include agricultural crops such as hay and pasture.
   YARD WASTE. Lawn or garden waste, including but not limited to grass clippings, leaves, mulch, brush, cut limbs from trees or shrubbery, and compost.
